Applicants usually have one year from the date of their last arrival in the United States to file an asylum application. Exceptions exist for changed circumstances that affect eligibility or extraordinary circumstances related to the delay.
What is asylum?
Asylum is a protection granted to foreign nationals who have fled their home country due to persecution or a well-founded fear of persecution based on race, religion, nationality, membership in a particular social group, or political opinion.
How does the asylum interview process work?
After submitting your application, you will be scheduled for an asylum interview with an asylum officer. During the interview, you'll discuss your application and provide additional evidence if necessary. The officer will then decide on your case, which may be followed by a referral to immigration court if not granted.
What happens if asylum is denied?
If your application is denied by USCIS and you are not in lawful status, your case will be referred to an immigration judge for a removal proceeding, where you can renew your asylum application. An immigration judge may independently grant or deny asylum.
