Changes to the Board of Immigration Appeals

At the direction of the current administration, the Board of Immigration Appeals published a body of immigration case law that significantly narrows the due process and relief from immigrant removal and deportation. The current administration also decreased the size of the board by nearly half — and appointed new judges to the remaining slate of judges.

In addition, last year alone, the Board’s decisions backed Department of Homeland Security lawyers in 97% of publicly posted cases. The Board has made it harder for immigration courts to offer immigrants bond in lieu of detention, and it has made it easier to deport migrants to countries other than their own. The Board did this in 2025 by quickly pumping out 70 published decisions, a record number of precedent-setting cases.
