Divorcing in Florida

To file for a divorce in Florida there are a number of requirements that must be met. Either you or your spouse must have been a resident in the state for six months to file for divorce. You do not need to allege specific grounds for your divorce, and can obtain a dissolution of your marriage by simply stating in your divorce papers that irreconcilable differences caused your marriage to break down.

If you have a minor child, or children, or one party does not agree to the divorce, the court can order you to attend marriage counseling for up to three months before going ahead with the case. Your marriage can be ended if you are both in agreement and file a joint stipulation or written agreement. There are two procedures for filing for divorce, regular and simplified.

Divorce process

In Florida, a divorce is begun by filing a Petition for Dissolution of Marriage with the Family department of the local circuit court. The defending spouse is served with the paperwork and given time to respond, after which the divorce can be finalized without a trial provided the parties can agree on property, child custody and support issues.

After filing the petition to divorce, either spouse can seek temporary child custody and support, and assistance for paying community debts.
