After receiving a decision in a case by a judge or a jury, the person who is not in agreement with the decision has a right to appeal the decision to a higher court in certain circumstances. The requirements for appealing a decision in the Florida state court system include the following:

  • The determination must be final. A final order is appealable.
  • The appeal must be brought within a timely basis. The right to appeal does not last forever.

In Florida there are three tiers to the court system. The circuit courts are the trial-level courts where actions, such as divorce proceedings, are filed. While circuit courts have some appellate authority, appeals of decisions of circuit courts are made to the district courts of appeals in standard cases. There are five district courts of appeal in Florida.

Sitting at the top of the courts system is the Florida Supreme Court, located in Tallahassee. The Supreme Court reviews decisions of the courts below in three general areas:

  • Decisions regarding validity of a state or federal statute or treaty.
  • Construction of a provision of the U.S. or Florida State Constitution.
  • Validation of bonds or certificates of indebtedness.

The courts of appeal do not overturn decisions made by the lower courts without good cause. Appellate lawyers need to make sound and reasoned arguments backed by legal precedent to win an argument brought before a court of appeal. The drafting of detailed appellate briefs and the skill of making an appellate argument require lawyers with specific training and experience.
